Terms of Service

Acceptance of Terms

By accessing or using deltatest.dev, the Delta CLI, or the Delta API (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, please do not use the Service.

The Service

DeltaTest provides an intelligent test selection platform that:

• Analyzes git diffs to identify code changes
• Maps source file line ranges to specific test cases via coverage data
• Enables running only the tests affected by your changes
• Stores and syncs coverage mappings in the cloud across your team

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice to users on paid plans.

Accounts & Registration

• You must provide a valid email address and accurate information when registering
• You are responsible for maintaining the security of your account credentials and API keys
• You must not share API keys across organizations or with unauthorized parties
• One organization account per team — creating multiple accounts to circumvent plan limits is prohibited
• You must be at least 16 years of age to use the Service

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any laws
• Attempt to reverse engineer, decompile, or access the Service infrastructure
• Scrape, crawl, or programmatically access the Service in ways that exceed normal API usage
• Deliberately circumvent plan-based rate limits or quotas
• Upload malicious code, virus payloads, or adversarial coverage data designed to compromise the system
• Attempt to access data belonging to other organizations
• Use the Service to facilitate spam or unsolicited communications

Violation of the acceptable use policy may result in immediate account suspension without refund.

Billing & Plans

Free Plan

The Community Free plan is provided at no cost. We may modify the free tier limits with 30 days notice. Continued use constitutes acceptance of the modified limits.

Paid Plans

• Paid plans are billed in advance on a monthly or annual basis via Stripe
• All prices are in USD unless otherwise stated
• Plan upgrades take effect immediately; downgrades take effect at the next billing cycle
• Taxes may apply based on your jurisdiction

Refunds

Overages & Suspension

If you exceed your plan limits (such as repository or test count limits), API requests exceeding those limits will be immediately blocked and return a Payment Required (HTTP 402) error. You can upgrade your plan at any time to restore full access.

Your Data

You retain ownership of all coverage mapping data and source file paths you submit to the Service. By using the Service, you grant DeltaTest a limited license to store, process, and serve this data solely for the purpose of providing the Service to you.

Upon account deletion, all your data will be permanently removed from our systems within 30 days. Billing records may be retained longer as required by law.

Intellectual Property

The DeltaTest platform, brand, and CLI tool are owned by DeltaTest, Inc. The Delta CLI is released as open-source software under the MIT License — you are free to use, modify, and distribute it in accordance with that license.

You may not use our name, logo, or trademarks without prior written permission.

Termination

By you: You may delete your account at any time from your dashboard settings. Deletion is permanent and irreversible.

By us: We may suspend or terminate your account with immediate effect if:

• You violate these Terms or our Acceptable Use Policy
• We are required to do so by law
• Continued provision of the Service poses a security or legal risk

For paid plan users, we will provide at least 30 days notice before terminating your account for reasons other than policy violations.

Disclaimer of Warranties

DeltaTest's intelligent test selection is designed to be highly accurate, but we do not guarantee that all affected tests will be identified. You are responsible for validating your CI pipeline independently.

Limitation of Liability

To the fullest extent permitted by applicable law, DeltaTest shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

Our total aggregate liability to you for any claims arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.

Changes to Terms

We may update these Terms at any time. For material changes, we will notify registered users via email at least 14 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
